Welcome to therapyonline.co.za. By accessing or using this Website, you acknowledge that you have read, understood, and agreed to be bound by the following terms and conditions (“Terms and Conditions”). If you do not agree to these Terms and Conditions, please refrain from using the Website. These Terms and Conditions constitute a legal agreement between you and TherapyOnline.co.za.

Services

1.1 Therapyonline.co.za provides an online platform that enables patients to book virtual therapy sessions with various psychologists (“Psychologists”) listed on the Website.

1.2 The Website is purely a medium for connecting patients with Psychologists. Therapyonline.co.za does not provide any psychological services and is not responsible for the quality or outcome of the therapy sessions.

1.3 The availability and scheduling of therapy sessions are determined solely by the Psychologists. Therapyonline.co.za does not guarantee the availability of any specific Psychologist or take responsibility for cancelled sessions or sessions that could not take place due to unforeseen circumstances.

1.4 Therapyonline.co.za acts solely as a booking engine that facilitates the ability to book an online therapy session between the patient and psychologist offering an online therapy session. Therapyonline.co.za will send the details of the patient booking the session to the relevant psychologist. The details would include but not limited to, the patients name, email, booking date and time and link to facilitate the online session. This link would normally be a zoom link but could also be any other online communication platform in order to attend the meeting.

1.5 If the psychologist using therapyonline.co.za does not connect with the patient, due to unforeseen circumstances or technical problems therapyonline.co.za will not be held liable.

1.6 If neither the patient nor the psychologist fails to log on to the online therapy session due to a technological fault, then alternative zoom link will be provided for by the psychologist at a time convenient to both parties, and no booking fee will be charged

1.7 Therapyonline.co.za will bear responsibility if there is a technical problem on the side of either the patient or the psychologist using therapyonline.co.za

User Obligations

2.1 By using the Website, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms and Conditions.

2.2 You agree to provide accurate and up-to-date information during the registration process and while using the Website.

2.3 You are solely responsible for maintaining the confidentiality of your account login credentials. Any activity that occurs under your account is your responsibility.

2.4 You agree not to use the Website for any unlawful or unauthorized purposes and to comply with all applicable laws and regulations.

2.5 You agree to only register one account

2.6 Therapyonline.co.za makes no representations about, nor do we guarantee the ability, reliability or capability of the psychologists providing the online therapy session to provide advice on the required areas of expertise or skills. Each and every psychologist has been vetted and it is confirmed they are registered with the HPCSA as a qualified psychologist

2.7 By scheduling an Online Consultation with a psychologists using the website therapyonline.co.za, the patient then enters into a direct, legally binding, contractual relationship with the psychologist with whom an online consultation has been scheduled.

2.8 Any disputes the patient then has with the psychologist that conducted the online therapy session must be taken up directly with that psychologist and therapyonline.co.za will not be liable or responsible under any circumstances.

2.9 No joint venture, partnership, employment, or agency relationship exists between the psychologist and therapyonline.co.za as a result of this agreement or the use of the therapyonline.co.za site, application, platform, and services.

2.10 The provisions of this Agreement are severable. If any provision of this Agreement is held to be invalid or unenforceable, such provision may be removed and will not affect the validity and enforceability of the remaining provisions.

Psychologists who use therapyonline.co.za platform

3.1 Therapyonline.co.za reserves the right to use the profile information of the psychologists vetted on the platform for marketing and promotion purposes.

3.2 Once a patient has booked a session with therapyonline.co.za, the psychologist agrees that he/she may not see that patient unless the session is booked via the therapyonline.co.za platform

3.3 The Psychologist/s using the therapyonline.co.za platform to consult with patients, act in their own, independent professional capacity during Online Consultations and remain solely responsible to the patient for any professional services rendered during the online consultations.

3.5 It is the responsibility of the Psychologist using therapyonline.co.za platform to insure they are available on the date and time of the scheduled online therapy session. They warrant they have a fast enough internet connection to make sure the online therapy session is successful. The psychologist must warrant they have a backup internet connection if the primary connection is not successful as well as any other device that that can insure the online therapy session is successful.

3.6 Once the online therapy session has been concluded, the Psychologist using the therapyonline.co.za platform has the responsibility to invoice the patient and include the relevant information so that the patient can claim from their medical Aid

Booking and Payment

3.1 To book a therapy session, you must provide relevant details, including your preferred Psychologist, session time, and any other required information.

3.2 The availability of session times is subject to the Psychologists’ schedules. Therapyonline.co.za will endeavour to provide accurate availability information, but it does not guarantee the availability of any specific session time.

3.3 Payment for the booking will be processed through secure online payment methods accepted by therapyonline.co.za. All fees and charges are displayed in South African Rand (ZAR) unless otherwise stated.

3.4 You agree to pay the fees associated with your booked therapy session, including any applicable taxes or additional charges. Payment is due at the time of booking.

Cancellations and Refunds

4.1 Cancellations or rescheduling of therapy sessions must be made in accordance with the cancellation policy specified by the Psychologist.

4.2 If you fail to attend a scheduled therapy session or do not comply with the cancellation policy, you may not be entitled to a refund.

4.3 Refunds, if applicable, will be processed according to the refund policy specified by the psychologist.

Disclaimers and Limitation of Liability

5.1 Therapyonline.co.za does not provide any psychological services directly and does not endorse, recommend, or guarantee the qualifications, expertise, or suitability of any particular Psychologist listed on the Website.

5.2 Therapyonline.co.za does not guarantee the availability, accuracy, completeness, or reliability of any information displayed on the Website.

5.3 Therapyonline.co.za shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use the Website or any services provided through the Website.

5.4 Due to the online nature of the Platform and the Services that the therapists provide, therapyonline.co.za and the Therapists are not equipped to provide emergency services to Clients.

Intellectual Property

6.1 The content, design, and layout of the Website is owned or licensed by therapyonline.co.za and is protected by intellectual property laws.

 Non-Disclosure of Information

7.1 During the online therapy session between the patient and the Psychologist therapyonline.co.za takes no responsibility for the safeguarding of information both sensitive and non-sensitive, that is shared, discussed or presented to either party during the session. That is the responsibility of both parties present at the online therapy session.

7.2 Patient and Psychologist use therapyonline.co.za and all its services at their own risk.

7.3 Patients booking a session using therapyonline.co.za do so with the knowledge that therapyonline.co.za will not be liable for any damages cause by the advice given by the psychologist using therapyonline.co.za platform and any consequence that results from the advice given by psychologist using therapyonline.co.za

7.4 Therapyonline.co.za will not be liable if an online therapy session cannot start or complete due to technical problems with the website.

 Indemnification

8.1 Users agree to release, indemnify, and hold therapyonline.co.za and its affiliates and subsidiaries, and their officers, directors, employees and agents, harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with 1) access to or use of the therapyonline.co.za Site, Application, Platform, and Services, 2) breach of these Terms, 3) the improper use of the therapyonline.co.za Site, Application, Platform, and Services, 4) any interaction between Users and 5) Users’ reliance on any information exchanged via the therapyonline.co.za Site, Application, Platform, and Services.

Terminations

9.1 Either the patient or psychologist that uses the therapyonline.co.za platform can terminate agreements at any time provided all monies due have been paid

9.2 Third parties services are subject to third party terms and conditions as imposed and therapyonline.co.za cannot be held liable for such third party terms and conditions or damages that arise due to third party services.
